MOSAIC FIREWOOD PERMIT TERMS & CONDITIONS

As a condition of entering Mosaic Forest Management Corporation (“Mosaic”) managed lands under the issued Firewood Permit, the Permit Holder agrees it has read and agrees to the following terms and conditions, and understands that a breach of a term or condition may lead to the Permit Holder being banned from Mosaic managed lands:

  1. The Permit Holder may only cut and remove non-merchantable wood in the area designated by the Permit (the "Firewood"). No standing or wind-blown trees shall be cut.
  2. The Permit Holder warrants that none of the Firewood shall be sold or traded.
  3. The Firewood Permit is for Permit Holder’s personal use only, and must be in Permit Holder’s possession at all times when cutting or transporting the Firewood, whether on our roads or otherwise. If requested by Mosaic or its agent, Permit Holder will produce the Firewood Permit along with government issued picture ID to show compliance with this condition.
  4. The Permit Holder agrees to keep ditches free of waste material and to remove personal litter. No smoking on Mosaic managed lands.
  5. The Permit Holder must follow safe work practices and use appropriate and/or required personal protective equipment.
  6. The Permit Holder must wear chainsaw pants or chaps, appropriate footwear, eye & ear protection, & gloves while using a saw.
  7. The Permit Holder accepts responsibility for any persons accompanying the Permit Holder and will provide these terms and conditions to that person for them to read and agree to prior to entering Mosaic managed lands. A reference herein to the Permit Holder includes any person accompanying the Permit Holder.
  8. The Permit Holder freely accepts and fully assumes all risks of injury, dangers, hazards and damages that the Permit Holder may suffer by entering Mosaic managed land. Mosaic and its affiliated companies TimberWest Forest Company, TimberWest Forest Corporation and Island Timberlands GP LTD (collectively, the "Affiliates") have no liability to the Permit Holder for these assumed risks.
  9. The Permit Holder waives any and all claims that the Permit Holder has or may have in the future against Mosaic, its Affiliates, and their respective directors, officers, employees, agents, representatives, successors and assigns (collectively, the "Releasees"), and releases the Releasees from any and all responsibility and liability, whether arising in tort, contract or otherwise, in respect of all loss, damage, personal and property injury and death arising out of or attributable to the state or condition of Mosaic’s managed lands and roads Permit Holder enters whether or not such loss, damage, personal or property injury or death is attributable to the negligence of Mosaic or its Affiliates.
  10. The Permit Holder shall indemnify and save harmless Mosaic and its Affiliates from and against and losses, damages, claims, demands, suits, actions arising from or resulting out of Permit Holder’s entry upon Mosaic managed lands.
  11. The Permit Holder agrees to comply with all applicable laws, regulations, and posted signs when traveling on Mosaic managed industrial roads.
  12. This permit is subject to cancellation by Mosaic at any time. Random onsite inspections are made for permits and safety equipment.
